Violette v. Ricart and P.A. Days
U.S. District Court, Southern District of Ohio
The Ricart and P.A. Days class action settlements
stand as one of MMM+B proudest moments. MMM+B
put an end to widespread predatory lending in central
Ohio's car market and made available millions of
dollars in cash in refunds for the class members. In
November 2001, an Ohio used car consumer - Robert
Violette - walked off the street into MMM+B's office
with a simple request, namely, convince P.A. Days, Inc.
car dealership to refund his money and return his
trade-in vehicle. Applying their knowledge of consumer
class action law, the attorneys at MMM+B did much
more, uncovering predatory lending that affected over
100,000 Ohio consumers dating to 1996 at P.A. Days,
and its parent company Ricart Properties, Inc. - the self
proclaimed largest Ford dealer in the world. In the
end, P.A. Days and Ricart Properties, Inc. agreed to
settle the class action, making refunds available
and discontinuing the objectionable practices. Ultimately,
P.A. Days, Inc. and Ricart Properties, Inc. made good
on their agreement to fund the settlement. At the time
of settlement, Defendents estimated the value of the
settlement to be over $18,000,000. They were also
forced to close eleven car dealerships that engaged
in the challenged practices. |
