Alternative Fee Arrangements

Because MMM+B sees itself as an innovator, it is willing to explore other alternative fee arrangements. MMM+B will consider providing legal counsel to a business in exchange for equity rather than cash. Likewise, in the plaintiff's side of litigation, we have used mixed hourly and contingent fee arrangements, sliding scale percentages based on amount of time, bonuses, and multiples of hourly rates-keyed to the success we achieve. We also negotiate reverse contingent fees based on the amount saved in representing defendants, after some agreed-upon financial exposure has been set by a liquidated contractual amount (e.g., a loan guarantee) or by an adverse jury verdict (where for example, representation is needed to handle post-verdict motions and/or the appeal) or by a final demand at the end of mediation. We also will handle cases for fixed fees plus a contingent bonus based on outcome, or charge a fixed fee per quarter to supervise other lawyers and handle specific other tasks.
